These Terms of Service ("Terms") form a binding agreement between NIUSIA CO.,LTD. ("NIUSIA", "we", "us"), a company incorporated in Japan, and the Assisted Living facility, home-care agency, or individual customer ("you", "Customer") that registers an account on Care-Call.AI (the "Service").
Care-Call.AI places automated AI wellness phone calls to residents enrolled by participating facilities, and provides dashboards, transcripts, summaries, and anomaly alerts based on those calls. The Service is designed to augment, not replace, staff supervision. It is not an emergency response service, a medical device, or a substitute for professional clinical judgement.
Large portions of the Service output — including live call dialogue, transcripts, summaries, sentiment scores, anomaly flags, support chat replies and email auto-responses — are generated by artificial intelligence models. AI output may contain errors, omissions, mis-transcriptions, hallucinations, or misinterpretations. You acknowledge that:
Care-Call.AI is not a medical device and has not been reviewed or cleared by the US Food and Drug Administration. It does not diagnose, treat, cure or prevent any disease. In a medical emergency call 911 immediately. Nothing in the Service constitutes medical advice.
We target 99.5% monthly uptime for the web dashboard and voice engine, measured as successful health-check responses during each calendar month. Scheduled maintenance (announced in advance) and force-majeure events are excluded. If monthly uptime falls below 99.5%, affected customers may request a service credit of up to 10% of that month's fees via the contact form on our website within 30 days. Service credits are the exclusive remedy for downtime.
